You are confusing 2 different cars. The car that was given a $0 offer was an older car. However, that dealer said that they will not buy any car that was in any accident for any price, so, my nearly new car would also be worth $0 to that dealer.

That is what I was told by my insurance company when I asked why they refused to go after the other driver's insurance for diminished value, effectively siding with their competitor (the at fault driver's insurance company) rather than their customer (myself).

I went up to an executive level and they explained to me how they pay claims from individuals claiming DV, but they take the position they only handle property not value claims so won't pursue it on my behalf. It helped me move forward working my claim. It seems to me this is a tort issue and cannot be dismissed by insurance regulation.

My guess is that the "dealer" did not say that. The dealer is the guy who owns the dealership. If you are going to take as fact everything told to you by any employee of a car dealership there is not enough help available to you on this entire website.

"They" didn't want to have anything to do with your beater, why should they? The dealer is not in business to help you save money or make your life easier.

But refusing to fairly compensate me for my car cost them my business. I took my business elsewhere. It seems penny wise and pound foolish to lose a new car sale where they would have made profit, because they refused to compromise on a trade-in.
