It's more about whether you are violating your state wiretap/eavesdropping laws, particularly if set to record audio without a sign giving notice.
Unless you are present or have explicit permission from someone who is there or authorized to hear any conversation that may take place it is illegal in all states. The only exception would be if the area where the work is being done is open to the public (ie it is expected that anyone can in that area without needing any form of permission or access)... which a mechanics garage typically is not.

This is what I don't get. Its not really eavesdropping if the camera is in front of the windshield like most cameras are. They should know and its not wiretapping as your not hiding it, now if it was hidden then thats the problem.

Yeah.. That's the problem.
MOST states are 'single party'.. What that means, is that so long as a single party of the conversation is aware that it is being recorded.. It's legal.
However, some states are dual-party.. Which means that both parties must be aware.
Regardless.. In a situation like mentioned above.. NEITHER party to the conversation is aware. And that is a technical violation of the law.
In all honesty.. an argument could be easily made that the mechanic that drives the car into the bay would have been able to easily see the dashcam and would be 'aware' that it was recording. I can't see any case being brought before a judge on this.. UNLESS it were a situation where someone's dash cam caught two mechanics talking about screwing a customer over and the customer was suing them and they made a motion to disallow the evidence under eavesdropping laws. something like that.
we seem to be focusing on the legal aspect to having your dashcam on in your car but i think that is a waste of a conversation. i wouldnt expect any legal action to be taken against someone who happens to have a dashcam that goes on when the dealer is fixing it (mine only goes on when the car is on so its not like i left it on at all times to record them).
i think the real issue is do we have a problem if the mechanic turns off our dashcam when in the shop.

And I'd have to answer that with a no.. Because if I didn't trust them enough to work on my car without recording them.. I'd have to think that I probably shouldn't be taking my car to them in the first place.

i could see people wanting to view inside the car for theft but for me the easier solution would just be to remove things someone would want to steal, its what ive always done. my dashcam only faces out the front and i could see them not wanting the inside of their work area for possible security issues and privacy issues of what they are doing in their business unrelated to your car. so i wouldnt care if they shut it off or covered it.
btw, if anyone doesnt have one they definitely should. it only cost me about $100 and saved me my $2,000 deductible when a guy who rear ended me lied and said i backed into him. best return on investment of anything ive bought. incredibly satisfying also, was worth having the accident to have the 1. fun situation of his family yelling at me and insulting me and 2. satisfaction of having the dashcam to come back with after the insurance rep told me his false story.
