19 year old lot tech with no license or ability to drive stick runs over and kills coworker. Lawyer is suing the Jeep's owner.

That doesn't really refute the clown world continues statement...

This case seems exceptional to me because the tech had no license and he was assigned to work on a stick without knowledge on how to drive one.

I learned to drive a 3 speed on the column when I could barely reach the clutch about 8 or 9 years old ,in the city of Boston ,less cars back then. Lol

I agree, too.

It seems to me, that if you take your vehicle to a legitimate repair shop/car dealership for work, once you, as the owner sign a repair order authorizing the work, and you hand them your keys, you are "out of the loop" until the work is completed, a receipt and your keys being given back to you.

I honestly do NOT see how or why, the vehicle owner has to be dragged through the mud, even remotely, over the negligence of the shop owner and "lot boy".... The shop owner should NOT have had an unlicensed driver as a lot boy, and the lot boy should have not tried to move the Jeep, if he didn't know how to drive a stick shift vehicle. You don't "practice" on a customer's car.

The owner of the car always gets sued. It's all part of the way tort liability works. It may even be required by the state's rules of civil procedure. In addition, the attorney would be open to a malpractice suit for not suing the vehicle owner as a potentially liable party.

Maybe. But however you would propose to change it would likely have it's own unintended consequences.

This was a dealership, which explains a lot about their service standards.


I was at a dealership one day and wanted to test drive a sports car that was in the showroom. The salesman said he needed to go find the dealership manager to move it out of the showroom because none of the sales staff could drive a stick. After twiddling my thumbs for half an hour, I finally heard the car being started followed by the loud sound of gears grinding, over and over and over. I took the car for the test drive but had decided before I even sat in it that I'd never buy that particular vehicle or anything else with a manual from that dealership.
