In NY you can decline to take a road test for being drunk but you instantly get your license suspended and then brought to the station at which point I believe you have to get checked for BAC. Not sure if you can continue to refuse testing at the station or not.

I'm curious because there is no way this lady was able to consent to anything.

You can refuse field sobriety test. However a blood draw is mandatory. You may request a second blood test at your expense and sent to an independent lab for testing.
