Reminds me I overheard a contractor in talking about asbestos. In CT they cleared it out decades ago.

I was provided with a document when I moved into my apartment about the lead test and it's not detectable.

Boston has issues because frankly the housing inventory is low..we're talking rock bottom low. I hear 25% of 2006 levels. If you go to suburban areas you are more apt to see newer housing that would be lead free.

Oh, Boston, and the whole lead scare. You would think kids in the rest of the USA must all be lead poisoned and retarded because we grew up without these restrictions. But we aren't.

OP never returned to clarify what they meant by being denied an apartment because of unknown lead status.

Find a place that has replacement windows and no flaking paint. Teach your kids not to chew on the windowsills or eat paint flakes. Enjoy your life. Stop being paranoid.

To be fair to the OP, most parents of young children aren't given the choice to rent the apartment or not. The landlord just denies them on the basis that they have the kids and he doesn't want to have to deal with the lead issue.

COnsidering the liabilities involved with renting to such tenants can you really blame them?

Yes, it's illegal.

You want to be a landlord, invest in deleading your unit.

When I was renting I never had any problems getting approved with small kids. I recall signing some kind of lead paint waiver though. Did the law change in the last 5-10 years?

I think that is a little glib. The laws are a little too draconian, and too little pragmatic, for my sensibilities. In theory, the costs should be passed on to renters, but then Boston rents aren't too expensive yet, are they?

I agree. I don't have a lot of sympathy for someone who's business plan rests on housing discrimination. The law may be excessive, but "I just won't rent to families" isn't a solution.

No one is forced to be a landlord...
