The rear corner of the house is sinking, and the bathroom has a 1 square foot hole going through the linoleum and underlayment near the toilet, with many other smaller holes also. I complained about it and they brought over a piece of indoor/outdoor carpeting to cover it and handed it to me at the door. This carpeting had no backing and dangerously slid on the floor. The gutters over the porch spill water onto the porch making it a virtual skating rink in the winter. Being fed up i told them that if anyone slipped because of this a lawsuit would ensue.
After this complaint, the landlord called me swearing and told me I could find another place to live as he "wants to move his friend in there".
the landlord also then removed the carpet from the bathroom.
They served me 30 days notice citing lease violations that are not on the lease.
I have a month to month lease starting on the 1st.
Can they do this? Is this not an illegal eviction being retaliatory? can they evict 1/2 way through the month, prorating rent?
Even with these particulars I am not sure you will win much of a fight.
Your lease is up at the end of the month, and you will be month for month. So the Landlord is within their right to choose not to continue the month for month. They have given you appropriate notice of such giving you a month to get out.
My suggestion, start looking for a new apartment.
Besides, why would you want to continue to live in an apartment you feel is (A) dangerous, (B) not well maintained, and (C) that your now in open conflict with the landlord?
30 day notice starts from before the 1st, so even if they served you on Dec 2, you need to be out by Jan 31
