You are probably out of luck......

But there are a few variables:
1. No guarantee the valuables you were thinking about were in the storage facility.
2. The hammer price (sale price) on the unit may have not even covered the lost rent. Its not like they display the heirloom jewelry for the buyers to see! They sell the unit contents as is, open door....glance at the junk and make an offer.

As for the locker, I assume even if you do have some sort of legal stand......it probably will not pencil out after legal costs.

If anything you might OWE them money if the rent was not covered by the sale of the items inside.

Facts: When she died, she was already behind in the rent. It was sold for being unpaid a full month after she died, and after you took over the estate. You had a month after taking over the estate, to find the paper and take care of the rent to get the things in storage out of storage. If you tried to sue or something, any judge would say that you were negligent in your executor duties, taking 3 years to go through her paper work.

As you took charge of the estate 3 years ago, and you just got around to finding the paperwork would go against you if you had any claim. Here three years after it was sold, due to non payment of rent, there is no way you can get anything.

Being it was sold over three years ago, there is no way anything could be located that was in the unit.

Just forget it.

It's moot point since I agree with you the OP is out of luck for all the reasons several people have stated. But I don't think the OP actually said how far behind the cousin was when the unit was sold. If it was said I missed it. OP how far behind was she, versus the date of sale?

IF the OP had known this a LOT sooner (like within months of the sale) he/she MIGHT be able to gauge whether they sold the storage contents too soon, or without proper notice. But more than three years later - forget about it.
