I think i have a great idea for a product that i'd like to patent and possibly even produce/sell. Has anyone here ever done that? can you please share your thoughts and experience?
I have a buddy who has a few patents however he used cheap lawyers or tried to do it himself so honestly his patents aren't really going to protect anything.
Make sure your 100% committed to your idea and well funded before even bothering to patent something because a patent is worthless unless you have the funds to legally pursue people who infringe on your patent. I coulld copy your idea all day and if you don't have the money to pay lawyers to come after me that patent doesn't help you at all.
I've also recently heard patents have a huge waiting time with the patent office.

I have an idea for a product I would like to sell.. it's not a new product or anything, more just designing an already existing product. Ex. a woman's "bracelet" with my own design.. of course I can't do a utility patent for the "bracelet" but I can do a design patent, right?
Is a patent a must, by the way? I was thinking of just having a prototype sold on etsy.com or something to see how it sells and if successful, go through the patent/trademark part.. but should it be the other way around? I'm afraid of putting it out there and then having my idea/design stolen.

You can file a provisional patent on your own for a couple hundred dollars. It will establish your filing date and protect your invention for a year while you determine if the invention is worthwhile. If so, you can file a design patent. The USPTO web site has a lot of information designed to help inventors with everything you need to file the provisional. You'll probably want to hire a patent attorney for the design patent. It can easily cost $5,000 or much more.
