layed off means you were not in the best of breed group to your company and they want to replace you. that is there option.

That's what my former employer did in 2009. They shut down one product line and scaled back the remaining product line. They ended up laying off about half the union workers at the plant and gave them severance pay. The union contract said that workers would have the right to any new jobs for a set period of time. (I wasn't a union worker so I don't know what the period was)

Right after the time ran out they ramped up production again hiring new workers at 13 dollars an hour while the previous starting wage was 24 dollars an hour. Pretty good deal for the company.

If your husband falls into a protected class (disability, religious, over 40, ethnic or racial minority), then he likely has a strong claim for wrongful termination (under the guise of a lay-off). An at-will employment may be termination for good cause, no cause, but CANNOT be terminated for bad cause. A lot of sneaky employers think they can get away with bad-cause termination by using "layoff" as justification. But, you should see a lawyer to advise what his rights may be.
