my sister is trying to get an apartment in Palmdale California. She's received 1099s and has had a temp job. After quitting her temp job to move, she will go back to 1099. The landlord seems to not want to rent to her because she's a 1099. She has enough money in her bank account, she has her tax returns. Can the landlord deny her for that? Can they deny her for owing in tax return (she has an arrangement/installment)? Landlord is asking if she paid her taxes... she's a 1099 but has already provided her checks and tax returns. ohh and she has nearly perfect credit score.

What kind of income proof can she provide?

In California the landlord can't discriminate based on source of income. That includes housing assistance, 1099, self-employment or unemployment insurance.

Not all places are set up to take housing assistance such as Section 8. It is not discimination to not take it. Discrination occurs when you take it from one person and not another. Building owners can choose not to be in the system so to speak.

Most places that I have dealt with want you to show proof of income. Also most places that I know of require that what ever source your income is that it be 3X the monthly rent. If you rent a place for $1,000 then you will need to show you are making $3,000 a month. As far as being a temp, if she can show that she has been working for sometime, and that she has an income that is 3X the monthly rent, I would see no reason not to rent to your sister. Other than that you can be denied for other things. If she has bad credit, or a Bankrupsi she can be denied.
