If you are paid every other week an emploer can work you 10 days strait without paying you overtime. as long as they give you 4 days off within the pay period. Lets say that the work week starts on a Monday and you work 10 days strait, then they would need to give you the next 4 days off or pay overtime for the additional days. Now lets say that the work week starts but you have the first 2 days off meaning that you started on Wednesday. They could work you 10 days strait and then give you 2 days off and then you would need to come back to start the next pay period.
It has been a while since I worked in the ski resorts, or for wages, us salaried, or rather formerly salaried get abused regularly.

Yeah the laws are different when you're salaried. BUT, salaried positions frequently have better perks to compensate.

I normally work 20 hours a week. This week will be approximately 25 hours (could have been 28 ).

Socialism (maybe I should call it nanny statism) says that an adult deserves a massive increase in pay (50% is a massive increase) for working a whopping 28 hours in one week. That is just ridiculous.

No job I ever had in CA require "overtime pay" for less than 40 hrs, even if my regular shift was part time. And you weren't hurt, you worked your hours as agreed upon. Stop whining.

I'll just go ahead and call bs like I have on your other posts.

This is a part time job. How much sense does it make to force employers to pay overtime on a part-time job?
I understand your frustration.

I'm afraid a similar problem will occur when the health care bill goes into effect. I bet we'll see a lot of employers cutting full-time positions to avoid having to pay insurance for them. This will lead to more employees, but less hours for everyone. Other than this, I completely support the bill, but this is a huge problem that I think will further hurt employees and needs to be changed.

Ok, this has been explained to you about a dozen times already but there's obviously a disconnect so here goes once more:

Quote:
Because there are two sources of applicable law (federal and state), a California employer must comply with both. California overtime laws differ from federal overtime laws in many respects. Foremost, pursuant to California Labor Code Section 510, non-exempt employees must be compensated at one and a half times the regular rate of pay for all hours worked in excess of eight hours in a workday, 40 hours in a workweek and the first eight hours of a seventh consecutive workday.

That's the law. If you really really think it's that oppressive there are 49 other states that have no such law. Please stop now.

Ah, yes. California - the working person's Nirvana, compliments of the labor unions, until the money runs out, they're chopped to part-time or their jobs are off-shored!

Now it's my turn to say "the sky is falling". Lots of hyperbole coming from those who accuse others of it
