Hi, my daughter has a car whose Arizona
registration will expire in a few days. The car
has not been smogged in California either. She
has obtained a moving permit that is good
until the end of December. She claims that
she won't get ticketed/car impounded/insurance
problems with the expired registration because
she has the California moving permit.
This seems unlikely to me. Does anyone know
the real answer?

what is a "moving permit"? Do you mean Temporary Operating Permit (TOP)? TOP's are normally issued when a vehicle has a paid registration (in which case you don't have) BUT has failed (or has not had) a smog test. The TOP allows operation of the vehicle to facilitate (weather going to the actual test or going to a service station to correct issues) taking the smog test only, not operating a vehicle without a valid reg.

Even with a Temporary Operating Permit, the ultimate decision over whether she can be ticketed or towed lie with the police. Some police agencies in the past have refused to honor the permits.

Hopefully she can get the registration process done as soon as possible, so this won't be an issue.

Yes, turns out it is a TOP. She did try to get it registered
but they want the problems fixed and smog test first.
Now she is hoping that the police won't check the
registration because it is out of state. I did check her
insurance and they will cover the car as long as the insurance
is paid up, regardless of the registration status.

A CA moving permit is a one day permit.
