California cities may not ban medical marijuana dispensaries, but the operations may sell only weed that is grown on site, an appeals court ruled in an Orange County case.

The unanimous decision by a three-judge Court of Appeal panel in Santa Ana was the first in the state to prohibit cities from enacting zoning restrictions that effectively ban all marijuana dispensaries.

Dispensaries can't be banned, but must grow pot on site, appeals panel rules - latimes.com

Can somebody explain to me how this ruling makes sense?

This wouldn't be an issue if the federal government simply removed the ban and taxed and regulated the absolute hell out of it. Kinda like feds and states already do with cigarettes, except this would probably be more expensive. People will utilize these dispensaries anyway, ban or no ban. I realize that it's "medical marijuana" now, but it's really not that difficult.

Actually.. that inst exactly true...

As far as a city using zoning laws to outlaw you are correct.... but a city DOES have the right to not issue permits to any business that violates federal law... which is the battle we are going thru with the dopers in Redding... ultimately in the next week or so I think the dispensaries will lose their court case here and will be forced to close under threat of civil fines and eventually criminal sanctions... sure they have blood money and will appeal ultimately losing in the end.. cities have the right to establish business ordinances and licensing ... this has already been upheld

And for me.. with all due respect to dope users... it wont be soon enough.

Kind of irrelevant if the Federal Government is cracking down on their being open at all. State can't issue laws that contradict Fed, no matter what this ruling states.
