My sister passed away a little over 6 months ago. She lived in Fresno. My mom had given her a ring which her BF said she pawned before she died. He said he would be able to get it out May 16. However, she died November 7, 2012. I am questioning his ability to return the ring to me. It seems to me the length of time should have already passed assuming she pawned it on November 6, 2012. Does anyone in CA have any answers for me???

Well, state law seems to require a 4 month contract length to redeem, with the item redeemable anytime within that 4 months.

Does he have the original ticket? You may have to purchase it back. If she pawned it, he's not responsible to return it to you, I don't believe.

Section 21201

shall clearly inform the borrower of his or her right to redeem the pledge

You can doublecheck this with any attorney. Sorry, but I think it's bad news for you.

Shall is my emphasis. Time seems to be expired for him to redeem it. But the pawn shop may still have it.

He told me they have it but he supposably can't get it until next week. I know he doesn't have to return it to me. He told me he would. Yes he has the original ticket and her death certificate. I just think he is lying about the whole thing in the first place.

Sorry about that. Perhaps he doesn't have the cash available to redeem it, or purchase it at this point? I don't know what their procedure is after time's up as far as purchase at market value or whatever.

Good luck. Where are you? Perhaps visit and pick it up yourself if he's not lying and the pawn shop actually has the ring.

Has he told you what pawn shop?

If they are reputable perhaps you could arrange a purchase by money order or the like and they ship you the ring?

First, just wanted to say I'm sorry for your loss. Second, you're probably right to be skeptical of the story. Unfortunately, that doesn't get you the ring back. You may not have good options if the BF is (for whatever reason) not forthright and cooperative.

Thanks everyone. I am in SW MO so very far away. I guess I will continue to wait and see if he returns it. Not a whole lot I can do from here. I don't wear jewlery but since it was my sister's I wanted it.

I recommend you get the name of the shop and contact them directly.

There's not that many pawn shops in Fresno I don't believe. Just start calling. They can check the records and see if they have the ring in stock still.

You may have to purchase it at market price, but I think they might work with you if they have it and you explain the situation.

There's a couple in Clovis also though. Maybe she went there. Check both towns.

Just in case, cross-reference with gold and coin dealers also. There's a couple in town that advertise as gold and coins, but are full service pawn shops as well. And they may not be listed under both listings.
