Um, what??

I'm only finding this on right wing websites not the mainstream. (as far as I can tell)
If anyone has more info on this or can confirm this is true I'd appreciate it.
At the moment the headline reads like something from "The Onion"!

Gov. Jerry Brown Signs Bill Removing Penalty for Using Gun in Crime - Breitbart

p.s. If this needs to be moved to the P&OC be my guest, just seems Calicentric to me. Thanks!

that's just right. if you kill a person using gun, does it matter that you used a gun? NO. your case is still murder or homicide

if you robbed a store using a gun, does it matter that you used a gun to rob it? NO. your case is still robbery

that's the logic of the law

This sounds like a continuation of Prop. 47 & 57 to let criminals out of jail and be among us.

Only in ca democrats reduce punishment for criminal while passing onerous gun laws to turn as many people into criminals as possible.

Using a gun in a robbery used to always carry extra weight in charges. It's certainly more traumatizing to the victim.

Murder of course is murder and doesn't matter what is used to do the crime. The victim is dead.

Why you want it aggravating when guns are readily available whether legal or illegal? 2nd amendment gives u the right to bear arms

If there is no gun right i can see the point of making it aggravating just like in Japan where using a gun to kill is already murder due to the fact that guns are restricted

Breitbart loves to twist a story to suit their own agenda. Beware of single site viewing and do your own research or you'll end up being a sheeple instead of learning how to discern between fact and fiction.

As for the article? Yes, a Bill was signed by the governor but it does NOT remove the penalty for using a gun in the commission of a crime. Here's the actual SB-620 Bill that was signed by the governor. Please read it and make up your own mind. You'll see that no where in that Bill does it say the firearm enhancement is null and void.

The bill allows the courts to ignore the 'enhancement' (using a firearm) if it wants to - i.e., it negates the absolute requirement, and makes it up to the judge (or part of a plea deal, which would have to be OK'd by the judge).

Thank you. Sensationalist media can only be effective if nobody ever checks out the details. That's on us to do. And fortunately, the details are available to us.

Thank God we still have a true democracy, with access to information. So, if we are uninformed, it's our own fault if we're ignorant.
