I currently work 2 jobs - W2 full time and 1099 part time from home.

I am about to apply for CA pregnancy short term disability, and later for paid parental leave. I won't be working my W2 job, so my overall income is lower, but I can do some work from home for the 1099 work, and can potentially make more than the disability payment.

My questions are:

-How will working as 1099 while getting disability from my regular job affect me?
Can I still get the short term disability benefits and later paid parental leave benefits while working for the 1099?

-Is the 1099 income reportable to the EDD as income?

-When applying, do I list 1099 income as a 2nd current employer? If so, do I report the employer name and address on the check?

I had a friend who could not work full time, but she was able to work part time. She was able to collect state disability based on what she was making part-time.

According to the rules, you need to be losing wages because of your disability, and they do allow people to work part time and receive disability, if their doctor said they have to work reduced hours.

But, I do think you're going to have to let them know how much you're making from the 1099 job. If it pays too much, you might not qualify for full benefits. Not sure.

I do think you could justify being able to work from home, though. At home you can lay down when you need to, go throw up when you need to, go to the bathroom every 3 minutes, etc.

I'm no expert. But, in my opinion you'd only possibly be paid less than what your full amount would have been. But again, not sure.

If you're just honest with them, they'll let you know. And if you get a note saying you're making too much money, then you can decide if you want to quit the 1099 job, then tell the state you quit it because you're unable to do that work now, too.

I was on state disability until it ran out between getting workers comp and SSI disability. I had a problem at one point over not claiming a final unemployment check or something, can't remember. But, it was no big deal to fix it and get the money rolling in again. So, I wouldn't be worried about just being honest with them.
