My landlord is mad because she didn't get the whole rent of $1500 because we failed the inspection twice, in 43 years, the inspector didn't due the standard inspection as required. He said the bathroom ceiling had peeling paint which had passed the previous four years, and bedroom door had a small crack which was fixed with toothpaste, also door frame was damaged, and striker was gone. Landlord was responsible but we had to repair it. I have photo proof of repairs done before the abatement due date, but no email site to send it to. Now she's saying we have to pay the balance she didn't get, saying it was our fault we didn't pass, we did. Told her that from now on she's fixing any repairs. She wants me to calll Housing to make them pay her

As the Section 8 program continues to evolve many small time Housing Providers are opting out...

I've managed Section 8 for 35 years and no longer accept new Section 8 due to program changes.

Last year was the first time I ever faced abatement...

Roof developed a leak in November... had a new roof put on ASAP... inspector comes for annual in December and says the eves must be painted...

I explained the unpainted eve boards are because the owner just spent 14k on a new roof... and the building will be painted in the Spring... eves and all.

Inspector said have it painted in 30 days or rent will be abated... NO ONE PAINTS OUTSIDE IN JANUARY... it was rainy, cold, humid, etc... didn't matter.

In your situation, there is a real possibility the HAP will be terminated... which leaves you having to find other housing... a lot of owners are also deciding to leave the rental property business and this may be the end plan.

The frame and striker missing would never pass HQS at move in...

Are you saying the owner or owner's workmen damaged the door frame and took the missing striker?

As a manager, I have had to repair tenant caused damages for annual inspection but always collected from the tenant for the repairs.

My suggestion is to schedule a meeting with all parties... and the inspector's manager... at least everyone will know where they stand.

First of all

Why was the door cracked? Why was the frame damaged and strike missing? Sounds like someone kicked in that door is what it sounds like. Doors just don’t get damaged like that without help. And I’m assuming the inspector expects the LL to repair it. I guess if they want to get paid..... They’re going to have to repair the damages. How was the door broken?

Go talk to a legal aid group for help, is my advice. And, you might want to start looking for a government subsidized apartment complex, instead of a private landlord. It's much harder for them to ever kick you out, if they are a management company/investment company that specializes in affordable housing.

Actually it can happen. The front door to my apartment has been developing a hairline crack for a few years now. It's still small, but I've been noticing it getting progressively wider. If the door was ever kicked or damaged, it was before I moved in. But my gut feeling is that it's just the wood cracking naturally. It's gone unnoticed through several housing inspections, but this thread makes me think I had better bring it to the managers attention before the next inspection.

That usually means someone moved further east from a medium sized city in the East Bay.
