Does everyone who buys diapers get the sales tax exemption? Yes
Is anyone who bought diapers barred from the sales tax exemption? No

There is no unequal treatment. 14th amendment satisfied.

The issue is not diapers, it is the sales tax.
Why should one group of people be exempt from paying sales tax, while another isn't?
That is the issue here, and that flies in the face of the 14th amendment.

Bob.

Bob.
It is already this way of sorts with AG equipment... and 5 minutes in any direction the sales tax varies on all taxable purchases...

California has no one Sales Tax for everyone as people in the Bay Area realize.

We use to buy cloth diapers in bundles to polish show cars... not even baby related unless your show car is your baby...

There is no "one group" exempt from paying sales tax. EVERYONE is exempt.

I can't make it any simpler than this:

If you buy diapers, sales tax you pay: $0.00
If you don't buy diapers, sales tax you pay: $0.00

Equal protection and 14th amendment satisfied.

Man, some people are thicker than glue.
This is NOT about diapers, or any other products.
It is about a particular group of people being exempted from paying sales tax.
Now what part of that do you not understand?

Bob.

Hey, why do we have to pay 9.5% in sales tax here when we can buy the same item in Oregon with NO sales tax?

Right, you want to buy diapers and pay no sales tax, move to OR. Problem solved.

The real issue here is if the new governor of California signs this exemption bill.
It has nothing to do with what other states are doing, or not doing.
If the governor signs this bill creating an exemption for people who buy diapers, that goes against the 14th amendment, by making a separate law for people who buy diapers.

We have an 8 and 3/4% sales tax here in Los Angeles, and if this bill is signed, people who buy diapers will not have to pay it.
The sales tax is mandated that everyone pay it.
Allowing some to not have to pay it, is not equal protection under the law, as written into the 14th amendment.
People buying diapers would be getting preferential treatment.

Because I am elderly, I don't want to pay sales tax on a new vehicle.
Think I'll petition the governor to give seniors preferential treatment, the same as the diaper buyers, if this bill becomes law.

Bob.
