I just purchased a vehicle about a week ago that needs a smog test and after closer inspection, it will need a lot of work before it can pass emissions. I wanted to know if it was possible to sell the car as is even though, due to not having the car smogged yet, it has not yet technically been registered under my name. Any help would be much appreciated and I have now learned my lesson. ty guys in advanced.

You should inspect it BEFORE buying.
Try to bring it back.

It is against the law for any seller, dealer or individual, to sell a car that fails to pass emissions to a person who lives in a clean air county.

Your info doesn't say where you live but I would assume it's California. Just take the car out of the state.

California is the only state that I know of that cares about smog.

There are many counties in many states that require emission test. Currently, there are 33 states that require testing in all or some areas.

Is that true for all states and/or counties that have emission testing? And if it is against the law, wouldn't it be, "it would only be illegal if the person KNOWS it won't pass a test."

I know of people who have sold vehicles in areas where emission testing was required, with caveats that stated the vehicle was sold as is and that included emissions. Usually older vehicles that have been setting for months or longer; however, all sales were considered legal. Some were taken out of state, some weren't.

Put in a Craigslist ad and sell it, don't mention smog. List it's good things.

Here in Washington State there are no longer any smog tests required.

In California, you have to smog it before a sale can be valid, so I would go back to the previous owner, ( if you are in CA) & ask them to smog it.

Sorry guys, new to this fourm. Yea I am part of California and thank you guys for the advice. Do you guys think that asking the dmv or aaa if it was possible to list the car as a non-op car and just sell the car as is. Seems like the best thing to do atm. If there was a better thing to do lmk. Tysm in advanced.

Get the title changed to your name, but don't register it. Just wait for the title to come back before selling it. That way you won't get accused of being a flipper or curbstoner. And yeah, sell it as a non-op project car (they sell like that all the time).
