Last year I made an offer to buy a condo. After inspection I found some problems and tried to re-negotiate the price but the seller refused. Recently I saw the seller put up a sign for private sale, can I buy his condo without seller's agent? I don't have my agent. The seller said it was safe to have the sale take place after 180 days from the expiry day of the contract beween him and the broker. Is it legal for me to buy even I have made an offer before? Can the agent come back to ask for commission?

The rules depend on the province. But if a buyer of a home was introduced to that home during the duration of a listing contract with a realtor - then that realtor is entitled to their full commission, even if the home is purchased after expiration of the listing. If it didn't work this way, every buyer and seller would try to cut a side deal to exclude realtors from the transaction.

That said, paying commission is the sellers problem, not yours. And the realtor has to prove that ownership was transferred to somebody introduced by him. Best to just let sleeping dogs lie and you won't have any problems.

Technically yes, but the commission directly influences the final price, so in substance, both the buyer and the seller end up paying for it.

If both parties expect to pay it going in, then yes. But in this scenario, seller secretly sells the home to buyer without expectation of paying commission. Realtor finds out and sues the seller for commission owed. As the realtor's contract was with the seller, not the buyer, nor the home itself - paying it now becomes the seller's problem.
