If you don't qualify, the only option I see is if you study in Canada and once done, the Canadian government has new programs for foreign graduates of Canadian universities to stay in Canada. Path of least resistance might be to marry him in the US now and try to straighten out his paperwork, but you will need to speak to a US immigration attorneyas well, since has that mark on his record of overstaying his visa.
