Okay, so the other day someone ran over the curb, took out some shrubs, BARELY missed the electrical pole (they actually went BETWEEN the wires going to the ground and the pole ) and took out a business sign and kept on going till they went completely THRU the parking lot before coming to a stop. I was not there and neither was my husband (we own the business property). Two young kids (late teens to about 21) were in the car and one of them was driving. Police came out and made a report. The father of the driver and the owner of the car came out later and wanted to "settle" the claim. Well, turns out he doesn't want to pay out of his own pocket but rather wants us to LIE about who was driving. He doesn't have insurance on his kid w/ a license to be able to drive his cars. We personally said afterwards when he left we don't really care WHO was driving. We are just going to tell the insurance we were not there and they need to fix our damages and THEY can settle w/ the insured on who was driving. The guy said he doesn't have them insured because it costs more . DUH! And his kids just proved WHY!! We don't want to get caught in insurance fraud at all. Frankly, as the mother of a teenager that will be starting to drive in a year I know that insurance is more for them but I'm going to pay for it. It IS the right thing to do. Frankly, they are dang lucky they didn't kill themselves or anyone else. There were no signs that they even tried to stop and no other cars were involved at all. I personally don't think the person should be behind the wheel of a car now after this demonstration.
Has anyone else been involved where the insured wanted to change who was driving? What happened? If the insurance finds out that the kid was driving, they will still be responsible for our damages, won't they? I would think so. I always thought it was the drivers insurance first and then the policy that covered the car second. Since the car actually has insurance on it..........????
None of this is your issue. Let your insurance company deal with his, and he can lie to his heart's content, and you're in the clear. If the police filed a report, and the Dad wasn't listed as the driver, there's really nothing he can do.
Likely, his insurance would be void if an unauthorized driver was driving. You would be covered by his 3rd party, but no damages would be paid to him for vehicle repair, and he'll likely be dropped by his insurance co. No different than if you get in an accident while impared. Insurance covers the damage you caused to others, but does nothing for you.
If the police came and made a report the driver of the car is on record. What does the report say?
I have not seen it yet. I would think it has the actual driver listed. I don't want to be a part of ANY scam and it doesn't help they are Nigerian........... Almost KNOWN for scams. urgh..........
We plan on just calling their insurance and saying that damage was done and they can go from there. We were just going to say that since we were not there when it happened and once we got there everyone was gone we don't know for ourselves WHO was driving except what is on the police report.
I still say they are just darn lucky they didn't get themselves killed or kill someone else. I don't know how "dad" thinks he can really get by with this if HE is planning on letting his insurance pay for our damages.
I say don't lie. Just describe what you saw and get your damages paid.
I don't plan on telling any lie. I just want to make sure they pay for our damages. If they get hauled off to jail for insurance fraud I'd be okay with it if they are going to continue to act like this.
Do not lie. You can go to jail for insurance fraud.
Usually anyone driving an insured car is covered unless they are excluded. Some policies will exclude people in the household who are known to be a high risk. My policy excludes our son becuase he flipped the car into reverse by accident when he was 3 years old and it hit another parked car. After that they excluded a three year old from covereage if he were to "drive" the car again.
Anyway, tell the truth. It is not worth the risk of losing the claim or going to jail just to help the guy out.

I'll vote for letting your insurance company handle this also. It's their job and they are good at it. Although it still involves you (your property) it's not your problem to solve this. And definitely not worth getting involved with any sort of games with this guy.

Agree. I had a situation whereby a neighbor hit my car parked on the street. "Dad" came over with teenage daughter in tow to tell me that she had hit the car. I didn't see it happen, but i truthfully had doubts as to who was responsible. When i asked "Dad" where his wife was, the look on his face was interesting. "Uhh, she's in the house, she's under the weather". My speculation was that it was actually "Mom" who caused the damage while being in an intoxicated state. Obviously, it was much easier/cheaper for the daughter to take the rap, and what could she really do about it? The parents were providing the car and paying the insurance, so if she wanted to keep motoring, she had to go along with it.
But in the end, it wasn't any of my business so long as i had their insurance information and an admission of guilt and a photograph of the damage to their vehicle.
You're doing the right thing Mom. You're doing the right thing by refusing to lie. And you're doing the right thing by making sure that when your teenager starts driving he/she is on your insurance. It IS the law, of course!
My wife & I are coming to the end of our "sky high car insurance days." Our sons are both grown, and our daughter is almost 18 (though we will continue to pay for her car insurance through college). Yep, the insurance costs a lot more. But what are you going to do? The only alternative is to not let them drive.
