My mother who is disabled and on SSDI takes care of my disabled brother who is unable to care for himself. We recently found out about the In-Home-Support-Services program in CA and are currently in the application process for it.

I am worried that if my brother qualifies for IHSS, my mothers income from this program would be considered as "Substantial Gainful Activity". According to the SGA rules, if my mother earns more than $1260, she would no longer be able to collect SSDI. This is a unique situation. I am not sure whether being an IHSS provider counts as "SGA" activity.

I know that IHSS isn't considered gross income to the IRS if the person receiving it is caring for a family member in the same household but I am not sure how the Social Security Administration will look at it.

Any help on this matter would be appreciated!

Here are the most common groups of people who have to pay a share of cost for IHSS:

People who get Social Security Disability Insurance (SSDI) and do not work at all, if their SSDI benefits are high enough to put their countable income above the SSI monthly benefits rate.
People who get veterans benefits or other unearned income and do not work at all, if their unearned benefits are high enough to put their countable income above the SSI monthly benefits rate. Note: Many veterans do not have a share of cost.
People who get Social Security or other retirement benefits and do not work at all, if their retirement benefits are high enough to put their countable income above the SSI monthly benefits rate.


I would call them and get clarification on it.
