In NY everyone recommends an attorney present...but it seems that not having an attorney is common in charlotte? Any opinions? If you recommend, what is the going rate?

If you buy new construction in NC you will more than likely use the builder's attorney; that's why it's important to have a Buyer's Agent. The Broker is responsible for the HUD even though it's done by the attorney.

I always make sure an attorney handles my closings. The rate vary from around $400.

NC is an attorney state. You can't have a closing without an attorney. The point in question I think is do you need 2 attorneys; one for the seller, one for the buyer. My point is that as a buyer your agent is responsible for the closing statement, the HUD. Even if the attorney works for the seller, so it's important to have a Buyer's Agent to review the HUD statement.

Um you do not need an attorney in NC you can use a title company or even a notary.

Yes, I meant do you recommend having your own attorney. I know one will be present for the seller - but I wasn't sure about the buyer. Are most new constructions fair/honest or will they try to take you for a ride at closing

They have to look out for you(meaning they have to play by the rules) unless they are just complete crooks. This is one good reason for having an agent. You should be for the most part.

North Carolina is an Attorney state. Closings are conducted by attorneys.

Charlotte Agent...The North Carolina Real Estate Manual 2006-2007 Edition, page 107.

"Because of the highly technical nature of real property law, examinations of title to real estate are made by attorneys at law or by paralegal assistants who are closely supervised by attorneys."
