I want to get a divorce and I have a low income. I don't know if the ex will sign the separation agreement and it is holding me back because they are ruining my credit. we have been apart for 2 years and children are involved. There will be no problem because there will be joint custody. But the problem is if they refuse to sign this agreement how I can get a low payed attorney? I am not public assistance or welfare. I am thinking about going through family law where a separation agreement is not as much, but if he refuses to sign, what is next? Could the divorce atttorney be expensive? what do I do? Is there another way to get separated? What about an allument?

If you were in love enough at one time to conceive children, why not try and reconcile your differences?
Marriage is the art of compromise! This country already has enough broken families and the ills that entail.

Many time with lawyers you can go in for an interview at no cost, check first, and then price a few. I would hope divorce would be after some couseling but only you know when enough is enough.
If you both can agree on most things they even sell kits at bookstores. It will tell you what you need to do and would probably save a lot of money.

Call the local bar association and ask them about legal clinics. Many cities have clinics for low-income people, or people just not able to pay but not technically low-income. Legal Aid is one organization you could contact as well. Good luck, I've been there and it is not easy emotionally.

First you contact the credit bureaus with an update. Then you get a laywer no matter what it costs and force his hand. Nobody "gives" the other a divorce. It isn't up for negotiation. You file, the court says boom, and you are out.

I have heard the "he won't give me one" crap way too many times and it is usually little more than "but I need his income". You take a divorce. Nobody gives you one.

Maybe you should contact the police! As far as a divorce,is there marital property that needs to be settled? If there is nothing to fight over you may not need a seperation agreement. Beware of joint custody. Who has the children? If he did evil things to you, can he be trusted with your kids? I think you should contact social services in your area for some guidance.Also,who is they?

If the soon-to-be-ex is roosting with another, you've got a slam dunk right there.

Forget an anullment. You've been together for too long for that. That's for people who pull a Brittney Spears and "Alabama neighbor" Vegas marriage. Kinda like, oops ( I did it again).

If infidelity is a factor, keep it off of here, especially if the other half knows you post here or can gain access to your computer. Remember, anything you say can be used against you.

Go down to the county courthouse and talk to the clerk. They will tell you what forms you have to file and tell you about a class you can take for a small fee about filing the proper forms to get your case heard before a judge. Talk to the clerk and ask as many questions as you can.

There are also fee waivers you can apply for when it comes to filing fees. But you have to take a trip to the county courthouse and ask where the family court is and then look for the clerk and ask them what you need to do.

Obviously, the best thing is to hire a lawyer, but the clerks at the courthouse have a tremendous knowledge base.

I need some assistance as well. My husband and I originally got married in Italy although I live in Iredell county. We have been apart for almost three years. I do not make much money but this is something that MUST be done. We do not have children together or any properties. Please Help!
