Dear Sirs and Madams,

I am new to this forum and to forums in general so please forgive me if this is a redundant question. I've read the vast majority with "berewick" in the title in hopes that I won't be repeating someone else's question.

My spouse and I are considering moving to the Berewick Community. I bet you've read that opening sentence 50 times in other threads.

I want to know where I can obtain a copy of the HOA convenants and restrictions, etc - so I can find out more about HOA expectations for this community.

The purchase contract I was given by my agent to review says that I have read over these things but I haven't yet and I'm not in the habit of signing something unless it is the truth.

I tried to obtain a copy from the HOA but was told that they don't hand them out to non-residents.

Additionally,

If anyone knows off-hand I have just a few questions:

Are there types of dogs that are restricted? We don't currently own any dogs but we would like to by one eventually and I know some HOA's restrict certain breeds.

Do they allow directv? I didn't see one satellite as I was driving through the area. I see TWC listed as a service on the HOA website but that means no NFL Sunday Ticket this fall.

Also, just out of curiosity what are the pros and cons of the HOA in your area (as of right now)?

What is the most annoying HOA rule (if any) that you wish would change?

I've learned quite a bit about the neighborhood, the schools, crime rates, morning traffic, etc. from reading the other threads.

The covenants are pretty standard. No trash cans out after trash day, keep your yard looking nice, you must have trees in the front, and if they die you are responsible for replacing them, get approval for fences and other exterior improvements, fences must be picketed and no more than 4ft high in either black, white, or wood, mailboxes are all the same, no signs in the yards (other than for sale), no parking on the street, no commercial vehicles parked overnight, no broken down cars in driveways, no campers or boats, etc.

I don't know about restrictions for dogs. Are you planning on getting a pit bull or something? There's a house with a doberman near me, so I know they are allowed. You can have a satellite, but the reason you don't see them is because you shouldn't. They are an eyesore. You are supposed to put them in the back where they aren't visible to the street.

There is not a "most annoying rule" as far as I'm concerned. They need to enforce the rules a little better as far as the parking situation and yard upkeep, but we just contracted a new HOA company, and they seem to be cracking the whip. We'll see what happens during the summer when yard upkeep is most important.

Keep in mind that a lot of the info about Berewick you will read on this forum is old. It's changed a lot in the past couple of years. For the better. Good luck, and welcome!

Ask your agent or the builder's onsite agent, if you went in without a real estate agent.

Association documents are on file with the Register of Deeds and your Realtor should obtain a copy for you. I'd be surprised if the seller or builder representative would not provide you with a copy as well, especially if you advise them that any offer you may make would be contingent upon reviewing them.

An abridged copy of Berewick's HOA documents were available at one time on the Berewick website. The community's management company, Kuester, probably does not photocopy and mail these out to non-residents because most CC&R's and related documents are rather large and they have been asked by residents to keep expenses to a minimum (i.e. mailing copies of these large files cost the community money).

Unfortunately the association is doing a terrible job at enforcing the bylaws. The house next to mine has had both front yard trees dead for over two years now, and they have not being replaced. There is always parking in the streets, every body does it, it makes the place look more ghetto than what it is. I would not look into moving here, since there are far better places in South Charlotte for about the same price. If I could sell my house I would get the hell out of that place.

CLTKing, they are doing a much better job than the old company. Report it to the girl at the Manor house and they people should get a letter. The OP is looking in the Shea section, and people don't park in the street in this section, FWIW. Also, I understand there might be similar homes in S.Charlotte for the same price, but "far better" is all relative. You couldn't pay me to live in S.Charlotte. I love it here.
