I recently got side swiped by another driver while I was stopped at a red light. I contacted my insurance to file the claim, who then contacted the other guy's insurance. I called the Arlington Heights police at the scene, who took down our insurance info. Few days later I got the report but it simply indicates "the two parties exchanged insurance information." It didn't assign fault. Anyway, his insurance has not been able to get a hold of him.

My next step might be to sue in the small claims court. The problem is, I'm moving out of state and won't be able to show up to court, if needed. I have heard that accident lawyers can handle without having the court involved. Does anyone have experience with this?

Why are you involved in this? Isn't it your insurance company's issue to deal with the other drivers insurance?

Yes that is what you pay for with insurance. You need to call your insurance company and work with them.

I agree. I'm pretty sure that his insurance company will pay at some point if he doesn't call them back. I recently had someone open their door into my car as I was driving by and he wasn't calling his insurance company back either. It held things up, but eventually they did pay. We didn't end up doing anything besides contacting our insurance and then waiting.

How much was the damage? You should have asked for a traffic crash report if damage was substantial and he would have been listed as unit 1 making him the at fault driver.
