If my neighbor owns a home, is it legal for him to rent out the individual bedrooms? If it is, how many people per bedroom is he permitted to lease to?

The house in question is a 5 bedroom single family home in unincorporated Dupage county. He is currently renting 4 of the 5 bedrooms to 3 individuals each- so renting to a total of 12 individuals, plus he lives there.

I'd contact DuPage County zoning department. If nothing else, it sounds like a real fire hazaed. Your answer's probably somewhere in here:

Thanks! I looked through all the zoning codes, but I couldn't find it there.

I searched for Dupage county landlord laws, but I couldn't find them... I could only find cook and Kane county landlord and rental laws. I know that it's illegal in Cook county, since cook county requires a certain amount of square footage per person.

Anyone have any other ideas or experience.

I also recommend calling the appropriate fire station / fire protection district -- firefighters HATE landlords that run illegal rooming houses as they are notorious for having fires with high fatalities. Make an anonymous tip to the fire department and that will often keep pressure on these sorts of situations.

There are legitimate ways to safely run affordable apartments, making sure that no one is going to end up in a horrible smoke filled illegal rooming house!

A lot of areas have exceptions for related family members and it's oftentimes difficult to know who's related to who. But your local zoning department, county in your case, should be able to easily provide you with an answer.

Sadly, there's been a trend to allow far too many people per square foot of living area due to all sorts of discrimination lawsuits that have occurred.

Usually under the "roomate" rule having one person live with you is ok as long as they share kitchens, bathrooms and doors dont have locks.

But what he has is more of a rooming house which usually are not allowed in single family zone areas
