Thinking about buying a condo in "good 'ol Chicago"? Better watch to see what happens with this proposed mandatory sprinkler system proposal. Doubt it, I remember hearing about retrofitting every high rise office building with sprinklers back in the early 00's and it never happened.

Unless you already own a condo in a building constructed after 1975 , and over 80 feet tall . That means you already have sprinklers. That covers quite a bit of condo real estate in certain areas, yes ? The mandatory sprinkler debate has been out there since at least 2005 . I think the state is trying to extend mandatory sprinklers to all new single family construction as well . The City requires LSE ( Life Safety Inspections) for all buildings over a certain size built before 1975 .

This is a very messy issue. A handful of towns in Illinois have requirements for fire sprinklers in all new construction. I have listened to the arguements from the fire officials (most of whom seem to have very generous honoria or ought right consulting gigs with the fire sprinkler companies...) as well as the counter arguments from the builders and home owners that have to repair damage from leak / freeze damage. I understand the safety of the firefighters argument and believe that is really the strongest arguement. The data in areas where wild fires are common and/or distance from fire hydrants / other infrastructure is far greater than in Chicago or the suburbs is also pretty sound. The risks of feeding into a system that, like elected politics in Illinois, is rife with abuses tempers the push to change laws to make this mandatory...

In my ward (46th), a great many of the highrise buildings were constructed before 1975 and would be affected by this law if passed -- including my own.

Here's an excerpt from the website of the 46th ward alderman, James Cappleman, detailing what concerned residents opposed to this bill can do:

What YOU Can Do

Write a letter to each of the JCAR [Joint Committee on Administrative Rules] Committee members to request that they each vote to reject the State Fire Marshall’s proposed rule to require water sprinklers in all residential high-rises. Form letters are discouraged, as well as emails. Your own personal story works best. If possible, enclose a photo of yourselves so that the legislator will see a face when they make a decision to vote. Your letter must be in the hands of the JCAR Committee members by Monday, Aug. 12, 2013.

Write a letter to Gov. Pat Quinn, letting him know the seriousness of this issue and ask him to plead with the JCAR Committee members to reject the State Fire Marshall’s proposal.

Write a letter to Mayor Rahm Emanuel, asking him to advocate to the JCAR Committee members on your behalf.

I will be working with other elected officials to map out a plan of action to gain the necessary support to vote this proposed ruling down.

It should come as no surprise to anyone who has watched Illinois politics for more than a few minutes to realize that these kinds of legislatives efforts are specifically crafted to "force" rules upon on those who claim to be fighting them -- Madigan has no high rises in his legislative district but many of his clients are the owners of these buildings. His genius is in using his ability to literally write the law so that if hit passes it will get huge contributions from its supporters in the fire sprinkler business and if it fails he will have gotten even bigger donations from those building owners opposed to it. He then dutifully doles out those campaign funds to those that voted with him.

Home rule in Illinois is always used as part of this corrupt tango of campaign funding -- if this was a state with actual integrity these fund raiser driven games would not be tolerated.

Based on an email I just received from my <current> alderman "Pass-it-Along-Bob" Fioretti , the State Fire Marshal has withdrawn the proposal ..apparently they received feedback of just how popular the proposal was from the recent town meetings . Puppies on the menu of Food Trucks would have gotten more support. And, so it goes ..
