I am looking at a studio apartment in Lincoln Park to move into with my sister. We want to put a deposit down on the apartment but the property manager said he needed to double check with the landlord on if it was okay for there to be 2 people occupying the studio. Has anyone else had any problems with this?

? Did they say it was a state restriction? Or is it just the landlord's policy?

Sounds like it is a landlord policy. I've heard of this more than a few times.

On a personal note, I would hate to live in a one room apartment with any of my siblings.

This doesn't strike me as the kind of thing that would be covered by a state law. Most landlord/tenant laws are local ordinances. If the landlord insists this is the law, ask him to cite the law.

Also, any maxium occupancy law would most likely be based on square footage, rather than studio or number of bedrooms. There are studios that are as large as some small one bedrooms.

Also, occupancy limits often exempt immediate relatives (cousins don't count but siblings do). I'm too lazy to look up whether or not that applies in Chicago and/or Illinois, but it's something to look into.

The state does have an ordinance, I believe it is 2 people per bedroom. And a bedroom is defined as a certain size: like 8'x10' or something and must have a window. You can't call just any cubbyhole a bedroom.

I am fairly certain, I read this somewhere. They have fairly stringent regulations about the bedroom thing because it is a fire hazard if you get like 15 people in a 2 bedroom apartment.

Studio: don't know.

so most second bedrooms in a loft do not qualify as a bedroom? cuz they typically dont have windows.

A technical bedroom must have a window or door to the outside -- This is for fire safety reasons
