In a ruling that could jeopardize the protection of more than 250 historic buildings and 50 neighborhood districts in Chicago, an Illinois appeals court today ordered a Cook County court to go forward with a case that seeks to overturn a city landmarks ordinance.

The 17-page decision remanded for trial a 2006 case that had been dismissed by a county judge, ruling that complaints from two property owners that the city ordinance was vague and vulnerable to abuse were valid enough for consideration.
Though the ruling is just one step in what could be a long legal battle, it was significant enough for city attorneys to say Friday that they would ultimately take the matter to the state Supreme Court.
"While they didn't strike down the ordinance . . . the way their ruling is worded, the trial court judge will have little alternative, once the case is remanded, but to strike it down," said city Law Department spokeswoman Jennifer Hoyle. "So our feeling is that we have to appeal to the Illinois Supreme Court."
The case centers on two neighborhoods deemed historic by the city Landmarks Commission: the Arlington-Deming neighborhood in Lincoln Park and the East Village neighborhood near Wicker Park.
Both designations came after failed attempts by aldermen to tighten zoning restrictions in those changing areas, said attorney Thomas Ramsdell, who represents the plaintiffs in the case.

Please edit your original post and cite appropriately. At least add something to your post that states your opinion. Many people on here read the newspaper so your post that just copies an article does nothing here.
