still waiting for something resembling a study or stats from you, this idea of PROTECTING YOUR PROPERTY RIGHTS means "pay your damn taxes" to most of us, as this isn't "Get offa my land 'fore I shoot yew" Wisconsin.

I'd bet you not 5 out of 100 people would be familiar with what I'm sure are arcane and byzantine laws on the subject, and I'd further bet not .1% of all Chicago lots have been officially resized due to an errant fence.

I don't doubt the percentages city-wide are very small -- the majority of the city was developed in a very regular way, every block having the same number of homes with identical lot dimensions.

All you have to do is open a plat book in area that is NOT like that and you will a fair number of changes.


EVERY attorney whose practice in any way deals with real estate is well acquainted with adverse possession and every surveyor is too. Most land lords and investors have a good handle on this, as should real estate agents.

Average home owners are surprisingly astute when it comes to knowing about other people using their land too...

5 in 100? Gosh, I dunno, what was Stroger's margin of victory in Chicago?!?!

what I'm saying is that people put up fences informally (ie, sans a permit) most of the time.

I imagine it's not uncommon to have a fence going a foot one way or the other, and I don't see anyone claiming that and getting away with it.

I'd still like to see one case of someone actually getting some of someone's property in the City due to adverse possession; I'm not saying it's never happened, but it is certainly foreign to me.

btw, this brings up this hilarious concept our home's owners told us about when they were griping about fence responsibility on the property (ie, why one fence looked like crap).

the guy tells me "Hey, you know the rule - you are responsible to put up and maintain a fence on the side of your yard that is closest to City Hall!"

I was just flabbergasted, I had never heard of such a thing, not that it doesn't have some common sense wisdom behind it.

Always put this stuff in writing - like a 1 page sketch with some notes as to how it will happen.
