Unfortunately, the way the laws are written, I think he would be arrested and charged. Unless Illinois is a Stand Your Ground state (which I highly doubt, given the strict gun laws in the city). But if you shoot someone in the back, it is assault/attempted murder/assault with a deadly weapon/a whole host of other things. Whether or not he would get convicted is a different story.

Only if he missed. Otherwise he would be charged with aggravated battery or homicide, depending on the final condition of the person shot.

Even though it may be difficult to rationally tell yourself in the moment that the danger has passed once the robber turns and flees, the law takes a dim view of shooting people in the back, even if they just robbed you.

If you murder someone by shooting them in the back as they run from you, society would be fortunate to have you placed in jail.

We have to remember that each case is different.

Gun ownership is a responsibility that many don't want. They can save lives, they can take lives too. If you take a life of someone who is innocent, you have to be prepared to take responsibility for your decision. It can work in your favor as well.
