In my guest bathroom there is a leak right about the toilet from the unit above (I'm sure thats the source of the leak).

I spoke to my insurance and they had said that I would have to pay the deductible ($500) and my premium may go up.

I'm not sure what to do in this situation as the only thing the building management says to do is read the by laws. Which is all in lawyer speak and I'm not a lawyer.

Any advice is welcome.

Based on the location of the damage you really should send the images to the HOA. They almost certainly have had to deal with this kind of thing before. It does not seem likely that his is caused by any thing in your unit, much more likely that it is from the unit directly above yours, maybe the common water service / drain line.

You could call your home owner's insurance agent and ask the agent if they have experience with dealing with HOA situations, really depends on the local office / market. I would not kick this up to a processing office until you have assurances that the policy will back you...

The management firm almost certainly is merely trying to delay the inevitable -- very rare that they want to cheerfully mediate between neighbors that may soon by pounding on the floor / ceiling...
