I know I feel very bad because I thing it was a 50 /50 but my neighbors doughter works for the court to so you can imagen that didn't help at all..

I can't imagine that was the case. According to the Ohio Revised Code, it's pretty clear that you are the one to be held liable.

Lawriter - ORC - 955.28 Dog may be killed for certain acts - owner liable for damages.

Most states hold dog owners liable for damages the dog causes, with only small exceptions.

Why??

THE OTHER DOG CAME OUT AND CHARGED @ HIS DOG,wasnt on a leash,etc.........

Well, for one, it sounds like this entire incident happened on the other person's property. So the dog didn't "come out" of anywhere.

It being on the person's own property also makes the leash irrelevant.

Had this person's daughter properly controlled the leashed dog, and everything else remained the same, the result might have been different being that the incident would have occurred off the other person's property, but since that isn't the case, it's not surprising the judge decided the way he/she did.
