The DOJ has joined several states in challenging the legality of the rules, specifically in regard to multi-time transfers being required to sit out a year-in-residence before returning to competition.
The original lawsuit, filed in the U.S. District Court for the Northern District of WV in December, was brought forth by seven states’ attorneys general and led by Ohio. It argued that the NCAA’s multi-time transfer rule served as an illegal restraint on college athletes under the Sherman Antitrust Act by hindering athletes’ ability to sell their name, image and likeness (NIL) and control their education. In addition to the DOJ, attorneys general from MN, MS, VA, and the District of Columbia also joined on Thursday.

In last year’s (2023) offseason transfer portal cycle, 136 FBS scholarship quarterbacks transferred to other Division I schools. The year before (2022), the total was 130.
This year (2024)? It’s the wildest quarterback transfer cycle we’ve seen, both in quality and in quantity. By the end of January, 148 scholarship passers had hit the portal, and the decisions each one made had far-reaching consequences.

The transfer rule was always going to get challenged because they are college students first. they should be able to experience the entire college experience.
When they do win, I wonder what this is going to do to those scholarship and enrollment rules between the bigger more prestigious schools.
Kids transfer for a variety of reasons including
1) NIL money
2) Playing time -- especially skill players looking for experience and game film to help them get a pro contract down the line
3) desire to be coached by someone who has a record of getting players ready for the pros
4) realization that they are going to sit behind someone better at school A but could probably start at school B
5) reasons like being homesick, wanting to be near girlfriend, having a brother at another school
Because of NIL and the transfer portal ----
What I think will happen at some point (soon?) is: players will have agents (lawyers), who will negotiate with school representatives (lawyers) and binding agreements will be reached where the players must sign a 1 or 2 (or more?) year contract in order to get paid and to be on the team. A big chunk of the money will go into escrow so if they jump ship early they lose the money but if they fulfill their contract they get it all.
The players will be contracted agents as opposed to employees.
I also think the 4 years of eligibility rule will out the window. You could possibly have players in college for 6, 7 maybe 8 years.
I'll bet there are hundreds of lawyers around the country already trying to figure out how to make this all happen.
