hi all,
I have just been asked by my ageing mother in law if I would help her with her financial affairs.
well, part of the plan is to sell her property in the San Luis Valley. the property is 160 acres located about 20min south and a bit west of San Luis.
I was thru there about 15 years or so ago with my father in law and we stopped in to talk to a local real east agent about some other property.
with all that being said, can anybody tell me if that office in town is still there? if not can anyone local direct me to a local, honest real-estate agent. im not very comfortable just calling somebody off the internet. and don't want to say anything negative about anybody. and honestly I am not sure what questions to ask of someone when trying to sell this kind of property.
if anybody could help me out I would greatly appreciate it

my mother in-law is telling me its surface water. I seem to remember talking about ditch rites?

the last time I was up there with my father in law we stopped in and talked to a real estate agent about some other property and water was discussed.
they seemed to think what he had was pretty good.

somewhere somehow he received some info about trading ditch rites for some other kind of water rites.

been a long time ago. never thought I would have had to take care of this so I didn't try and file it back to the memory bank.

ill see what kind of paper work I can find and post it

ill check for mineral rights. im thinking not much there

Track down what is going on with the errr ditch rights which is just another term for water rights. Water is everything in the San Luis Valley just as it is in the rest of Colorado. Without water rights that property won't be worth much.

thanks. she's supposed to get all of the paper work this week ill get into it and get back to you
and im pretty sure there's some kind of water rites. wifes dad always wanted to farm it.
when I was a young man he tried to talk me into moving up there and raising potatoes. I went to the store and could buy a 10# sack for a buck fifty. I decided to keep my construction job.
after that I always put farmers and ranchers up a littler higher on the totem pole. those folks deserve it.

When it comes to water rights, Colorado is a "use it or lose it" state. If decreed water rights are not used over a period of years, they can be put on the "abandonment list" by the local water commissioner and eventually voided. So, you will need to see what rights you have with the property, if any, and if they have at some point been declared abandoned.
