If you're willing to use a product that you got illegally from a student, and now want to finagle a way to cheat the company again by using it past the allotted number of licenses, why would you balk at buying it on eBay?

I didn't think I got it illegally from the student though. I read that in order to get the product for a much much cheaper price, you had to be a student, so I got the student to buy it and then give to me. It didn't say anything about giving the product away to someone else, as being illegal when I did that, so I assumed it was legal. Lots of people buy things, and then give them to other people after, so how was I suppose to know that this one particular case, it would be illegal?

I think if you would bother to read the license you'd find that what you did is illegal. The license states that it is for use by a student. Just because it was given to you by a student doesn't make it legal for you to own.

In answer to your question, "How was I supposed to know..." you were supposed to know because you were supposed to read the licensing agreement. Just because you didn't doesn't change the agreement. When you installed the software you agreed to the license. That information is in the license you didn't read. The one in the paperwork or the dialog box you didn't read when you put a check mark in that little box that said you agreed to what was in that box. And that would be... Ta da! The license agreement.

You can dance around it, try to find some logic that will change it, hope someone here says it's okay - and they might - but they are wrong as well, but it all boils down to the fact that you did not obtain the software legally.

Easy, huh?

Oh okay. After the student bought it for me and gave it to me, which I payed him for, I then installed it on my system. I filled out the registry license and filled it out with my own name and they accepted it.

So since I thought they accepted me registering for it, even though it was purchased by someone else, that the company was okay with it. The company would have noticed that a student purchased it, but yet someone with a different name registered for the license, and they still didn't say anything, so I didn't think they had a problem with it.

i think there is a big jump between doing something criminal and not abiding by terms of service.

Let's say they didn't catch it or simply didn't care at the time. You've still used the number of activations allowed by the license, so you'd still need to fork over more money.

[ianal]^ yes it is (i cant imagine any state where this is against the law). this has nothing to do with criminal justice. this is about an agreement between 2 private parties.

your gonna' call the cops because the number of licenses he had expired ?

ianal is shorthand for: i am not a lawyer -- i was not dissing you.

lawsuits are a totally different entity than criminal court. e.g.- o.j. simpson was famously aquitted of criminal charges therefor avoiding jail time/probation/community service; however, he was found liable in civil court and ordered to pay restitution.

you can sue for any reason in the united states (so long as your willing to pay the lawyer fees and court fees -- as well as the court fees of the defendant if you lose).

to be arrested and to be required to go in front of a judge, you technically need to be charged with violating a specific statute or code.
