My landlord was installing a new oil tank for my part of the house. He lives downstairs and I live upstairs. Well, he insisted that I use his oil company even though I have my own company which I have a budget plan with. I pay them over one hundred dollars a month. Now, I owe my landlord eight hundred dollars too. I know he wanted the money to help pay for his new oil tank. I have been out of work and living on savings. This presents an extreme financial hardship for me. Are there any lawyers out there. Was this a legal thing to do on his part? I told him that I could not afford it but he went ahead and did it anyways. I would appreciate some advice.

I am not a lawyer but this does not sound right. Do you have a lease? If so read it carefully. Also you may want to check to see if there is a Fair Housing office in your town. These are just some quick thoughts. Jay

My understanding is that unless the requirement to use a particular vendor is in the lease he cannot compel you to do so after the fact. It is my understanding that this would not hold up in court. I am not a lawyer either, but, if I were you, I would tell him to go fly a kite.

+1.. If it's not in the lease, it SHOULD be YOUR decision... What's the $800 for BTW??? I hope not the tank. He owns it, his responsibility to replace it and provide heat if he wants to rent to someone.

Does the new company not offer a payment plan? I understand this sounds like a blackmail type situation but if you're living hand to mouth and you've missed one month (assuming from the $800) then it's in your best interest to at least try to work with the new company to design a plan. Are you in the hole with the old company? Is that why you can't switch?

If you can I would agree to go with his company in writing and express this is a one time offer to modify the lease and future exceptions will have to be approved separately.
