I've been behind on several HOA fees. I have paid them a portion of it, but now, they are moving forward and filling foreclosure proceedings against my property.

I have called the law office that is handling the case. I've asked them for the exact amount that I owe and if they are willing to receive partial payments. The person who's "in charge" of the file is not giving me ANY information at all on the case. I've called them many times. She keeps hanging up on me. Very rude and unprofessional behavior!

What do I do? I am WILLING to pay the charges, but if they don't tell me the amount, how will I know what to pay?

The other thing is, if I do pay all the charges, can they still move forward and foreclose on my apartment?

Please HELP!!!

Umm, just going to ask the obvious ... How is it that you don't know what you owe?
What are you monthly common charges? what checks or receipts do you have or bank statements do you have to show what you paid? Dues-what was already paid=what's owed

The last amount that I KNOW of was about 650.00. Now the court papers just says "monetary damages and that the amount, legal interest or property in demand is more than 2,500".

That was the reason why I called the law office. I wanted to them to give me a run down of what they were actually charging, but as I mentioned, the person was very rude and gave me no information. Now I have no idea how much they will add on to the final amount.

I have a feeling they actually WANT me to default and wanted to foreclose on my property.

Did you call the knuckle head neighbors on the hoa board, or the accounting office of the management company collecting dues. A paralegal at the lawyers office will help file the court paperwork, but probably doesn't have YOUR accounting.

You might want to get your own lawyer to help you sort this out. This is one of the things I hate about HOA's. no one wants to help straighten things out. Jay

Sounds like a Co-Op to me. They should be banned IMO. It's not real property. You only own a share of the entire association. But yes, they have a right to do such thing and add any additional cooperation legal fees for moving forward with process.

Did they send letters stating you were behind? If so for how long?
What is the maintenance per month?
Is there an assessment fee you havent paid?
Is there a mortgage on the property? The bank will become involve too.

Ask for a Short Sale instead. But more importantly if you want to keep the property ask for a meeting with the board and see if they can withdraw all this. Tell them you're willing to pay them whats owed + 3 months in advance.

I have only received one letter at the beginning of this year stating that I owed money, the next one was for the foreclosure notice!!

Maintenance fee just went up to 180, and the assessment I have NO idea cause I just found out that they have not been sending them to me. The property has no mortgage.

Whoa. $180 a month. That means you were behind almost 4 Months? But you say they sent a letter to you beginning of year. Does that mean the last payment you made was last year sometime??? So are you 8 months behind now?

Only thing I can say is be proactive... find a rental... unless you can work magic or unless there's something in the bylaws that will go in your favor...you'll lose this property.

I'm not behind 8 months. I was behind a couple of months last year, but the fee was 140 last year. It just jumped up to 180 this year.

The management company said they sent out letters that I was behind, blah, blah, blah. I never received ONE letter. The only thing I ever got was one from the lawyer (of course they made sure I got that letter) and the court order to foreclose on my apartment (of course they had to make sure I also received that cause it's the law).

Those B*t*rds!!! They're just out to get my property. They know they can sell it for a high price cause it's in a prime location.

I'll just have to lawyer myself up.

GET A LAWYER. This is not something you want to fool around with. To lose your home over a few hundred dollar is foolsih. DO IT NOW. Jay
