In my experience, most towns/cities require it to have some kind of grate or lid on top of the flame.

That. The firepit has to be contained, not merely a hole in the ground. You can't just have a bonfire in your back yard. You can have a woodburning stove, or a woodburning grill, or a stone-enclosed oven. You don't have to use them for cooking, but "open fires" are tightly controlled in this state by the different towns. Each town has its own specifications, but that's the general idea of it.

As always call your town. Think of others around you before thinking of red flags only. Winds and droughts do effect the hazards of outdoor fires so just respect the neighbors as well as your family and personal property. Doesnt take much for a ember to fly and start a fire elsewhere other than the pit.

Also think about the smoke that might affect the neighbors and pets as well.

"Very early that morning a metal waste basket was used on the deck of the house where it started has a fire pit. It was left on the deck and would eventually start a fire that destroyed the residence and spread to the neighbors home destroying it while the conflagration continued to cause significant damage to three other dwellings."
