Connecticut is currently, I believe, one of three states ( CT, MD & MA) that require there can be no discrimination based upon income. Other states allow Section 8 participation to be voluntary.

However, while a landlord cannot discriminate based upon income, a landlord can impose any number of qualifications upon a prospective tenant, as long as those qualifications are used across the board to all possible tenants.

One other note: HUD/FHA does have requirements as to how many people can inhabit a rental unit.

Section 8 guidelines for unit size

If you have a property on septic system one would need to be particularly careful with how many people are living in a home- septic systems are designed for 2 people per above grade bedroom .

Just to be clear--that's no discrimination based on legal source of income, not no discrimination based on income. Obviously, as a LL you still have the right to require a certain amount of monthly income from tenants.

Where does it say 2 people per bedroom? Do the number of bathrooms factor in?

6 cars in a small driveway? (assuming 2 adults per 3 bedrooms)

Not trying to be a wise ass, just curious!

Parking is not addressed in discrimation laws or affordable housing.

Just llike anything else concerning a rental property it should be clearly stated to all parties involved in the lease so everyone is aware whether it is 0 or 1000 parking spaces provided.

The basics are outlined in the link provided by the poster in post #45.

And none of it is set in stone. If one were to find themselves in court everything is up to interpertation.

LLing requires knowledge of the everchanging laws and one other important behavior.
Consistency.
