My ex-husband works for a non-profit agency as a chef. I only get $400 a month for my 2 kids from him. They claim he doesn't make enough for him to pay for medical for them and that his income is restricted, therefore the reason why child support payments are so low.

Sometimes he works over 60 hours a week. He said they don't pay him overtime because they don't have to (maybe being that they're non-profit?). He was trying to explain to me that on his time card it shows that he works 2 different jobs (he basically does the same job all day, but if he works nights it shows as something different).

One of 2 things:

1 - he's feeding me a whole bunch of horse manure.
2 - he's in fact correct, and can get away with this.

Can someone give me advice.

I'd consult an attorney, when you go to court for a modification the will personally look into this finances and come up with a good number. Often times they will even have it automatically deducted from the account.
I've never heard of a not for profit NOT paying someone for OT....so I think that's untrue.

no a non-profit is technically required to pay for overtime for a non-exempt position, just like any other employer in the US.

As someone on the flipside in your position (I have a 19 year old in UCLA right now who *I* had to file for paternity rights. )...I think he is either - getting taken for a ride by his employer or playing YOU for a fool.

I know a GOOD family law attorney here in Hartford that is honest, simple and would be more than happy to take a look at your situation for no charge and give you and HONEST evaluation.

he does not sound like he is getting away with much, 60 hours a week is getting away with something?

Yes it's called getting away with earning more while paying less.

in the food biz people often pay cash.

I agree with the above posts, it sounds a bit sketchy (I don't know of any job including non-profit where you can get away with not paying overtime). It sounds like someone is getting screwed in this deal either way. I would consult with a family attorney as mentioned above. If you cannot afford a private attorney look into what the state can provide for you, I'm not sure about attorneys but I know Dept. of Children and Families have services open for people who ask for it (these are not the same types of services/DCF involvement as for abuse or neglect), and there are other state agencies that go after "dead beat dads" (I know this as a cousin of mine works doing this, but I'm unsure of what agency she actually works for.) Look into your options... and good luck!

Yeah that sucks. 400 dollars isnt much to help out with 2 kids.
