In AZ we have the 'stupid motorist law' and he would probably have been sued for the cost of his rescue. Since he knew it was a bad road to begin with his common sense went out the window.
Why doesn't he go out on a limb and sue mother nature for the storm, jeeze. There are so many holes in his lawsuit that I bet if it went to trial the jury would laugh him out of court. He's probably betting on a 'settle out of court' agreement.

“And I'm talking to the rescuers and I say, ‘You're losing time, you gotta do something,’” he said. “They didn’t do anything to try and save his life. I talked to the tow truck guy who talked to the rescuers and he said, ‘two are safe, one has died.’”
At the very least, someone with the fire department and the county are negligent. This guy was in the water for TWO HOURS before they decided to check the car for his body? And THEN they found him alive? And his brother was there all along, saying he KNEW his Mr. Ortiz was STILL in the car?
