I've been able to tell when someone is transgender--MTF or FTM, it's always fairly obvious to me. That being said I'm sure I might come across a transgender that really looks like the gender they identify with. In those cases I wonder what the potential is with pursuing legal action? It begs the question should people that transition into a different gender be forced to disclose that to new partners?
I don't think the woman in the OP will win this case--there are just too many red flags that should have been alarm bells for her. I have never used a strap on so I don't know how "real" those feel, but something tells me that any sane person would be able to tell the difference between a "real" d and a fake one.

How could she not tell? I can always tell. I have never seen a transgender person who was born a female who looks, convincingly, like a person who was born a male.

She's (he's?) being more than sued. She's being charged with assault.
Not really sure how this will turn out, after all she consented when she thought it was a male she was sleeping with. According to many here she shouldn't be charged if she is transgendered, I suppose. Does this indicate a need for laws concerning disclosure? I tend to think so, otherwise how can you completely give consent?
What a can of worms.
People should have to disclose their sex and if they're transgender for someone to give consent. Fooling someone by not disclosing this info isn't only disgusting but should be required..
