I moved into a home in September. Afterward, we find out that our yard is infested with Copperheads. We have a wildlife exterminator that has estimated at least 60 in our yard. Is this something that should have been disclosed to us? If so, what do we do now?

Since we moved in the fall, it was not an issue. But they come out in the spring. According to our exterminator, this isn't an issue that would have just popped up. It would have been an ongoing issue that they would have known about being they lived here for a number of years.

Not funny. Two of my dogs have been bitten and my children can't play in our backyard because of this issue. I have almost been bitten. Thanks.

Termites infesting the house is a material fact to be disclosed. Copperheads in the yard is not in the house and not threatening the structure of the house and thus does not need to be disclosed. I have rolly pollies and daddy-long legs and other such things around my house. I've found scorpions in the house every so often. That has nothing to do with the structure of the property.

The house in the story above is probably just needing to be condemned and torn down.

In your case.....if the previous owners KNEW that the property was infested to the point that the house/property was probably a sanctuary or den for them and it was a problem there could be some recourse. Unless.......... you live on acreage near the lake and that is just a matter of being in their territory and to be expected...... then there would be no recourse. If the house is in a subdivision and you find out the previous owners had an issue w/ the house being located on a snake den......... I'd find out what recourse I had for sure as you COULD have some. It's to iffy to just flat out say that you don't have any recourse at all.

How do we go about finding out if the previous owners had knowledge? All they have to do is lie and say they didn't know, right? We do not live near the lake. We live in a subdivision.
