i think you will get the earnest money if for some reason you can't go through the closing. that's what my builder told me when i gave them my earnest money although they were not obligated to give it back to me. in the end they wanted you to be a happy customer or a happy potential customer for the future.

Thats totally dependent on who the builder is. There are certain builders that never give it back.
