Hi - if anyone has any advice on how to handle this it will be great appreciated.

I viewed this complex in August and looked at a smaller unit but decided to go with a larger unit that would be available 10/22, so sight unseen, because the smaller unit looked great.

When I moved in the floors were coming unglued and the tub has a 6 inch hole in the bottom of the tub. No joke a huge hole! I contact the management company just for him to tell me it will take 3-4 months for a new tub and sorry about the floors...nothing they can do.

Is this a code violation? I want out of this lease and need any advice I can get so that I can move to a proper place. His response to me was they 'must of missed somethings' and that 'sorry its not up to my standards.' Really...what property management company tells a new tenant this!!

The hole in the tub may be an issue to take up with city Code Enforcement since that is a health/safety issue.

I guess you’re going to have to have to trip on the unglued flooring and send a bill to the property management for your medical expenses……….

Maybe send them a notice in certified mail that you have stumbled on the unsafe flooring, that you have advised them of this hazard, and due to this unsafe living condition and their refusal to glue down the flooring you cannot reside there. Tell them they have one week to schedule the repair or move you to an acceptable unit.

Texas has really bad landlord/tenant laws and unless it's a major safety violation like non-functioning AC and heat or no water, you may be out of luck and just have to work with the landlord.

Thank you. More concerned about the tub than the floors and contacted the city and they are coming to do an inspection and contact the landlord.
