Maybe people should stop stealing. You think these thieves would get it through their head that they can and will be shot.

Notice no one cares if they get shot over A/C.......but something like $1,000 makes him a murder...

Est. cost of the copper $200 dollars

If you rule out the $32,500 fine the EPA would have given him.......is more greenhouse gases enough to shoot thieves over?

Thievery is enough to shoot thieves over. It's not the $200 worth of copper, it's the money lost to do all the repairs.

Don't steal, don't get shot.

Well I don't know what side I'd fall on. There isn't enough data. Did the Owner tell him to stop and the thief keep climbing? Or did he just shoot him in the back? Since the police declined to bring him in I'm guessing the former. In which case although shooting him isn't the action I would take, it is certainly a legal, and acceptable response.

Since the argument against self defense was all about how much the items were worth.

Let me make sure I put a $ amount on that

$200/copper

Again I don't know the circumstances. Was the thief threatening him?, was there a reason for him to feel scared? Without more evidence I can't render a verdict
I will assume that the police on the scene thought he was justified. As of now I know no detail so I assume they were correct to to so determine. If tomorrow I hear the owner yelled "I'm going to kill you," the man said "No please I'm coming down just call the police" and the owner shot him, that would be not just wrong but evil. If I hear the owner said" stay right there while I call the police" and the thief made a threatening statement, or movement... that means something else, and there are all kinds of degrees in between. My personal morality would only let me shoot someone to defend my or others safety, but that isn't what the law says.
