I placed an order through a website for a company based in Lewisville. The website accepted my order and billed me for the item via PayPal. I paid for the item but then never received it. I contacted the company for a refund, but they have given me nothing but excuses.

The company accepted orders on their website for another month or so, then took the website down. The company still operates as services company.

It appears to me like the website was operated with fraudulently, with no intent to ship the ordered items. Are criminal charges appropriate for this in TX, or just a civil claim?

I'd call the Lewisville Police Department and the Texas Attorney General and ask them as well as making them aware of this business.

If you used a credit card for payment via PayPal you might contact the cc company about them backcharging the charge since it was never recieved.

I too would contact the Lewisville Police dept. If this happened to you, I am sure it has happened to others and the police will want to know. It sounds pretty fraudulent to me.

Dispute it through PayPal. This is the obvious answer! Unless the company has proof that they mailed it, PayPal WILL refund your money!

PayPal is really good about refunds. Of course, I hope you paid for insurance on the shipping. I got a package that the USPS put in a plastic bag with a "sorry" letter in it. The package had tire tracks on it and was completely smashed! At least they were honest about it and I had insurance.

I have found that PayPal is actually very poor at refunding your money. PayPal will not refund my money, as they said I waited too long (their window for disputes is only 45 days). I first contacted them within 45 days, and they stated that the merchant must refund the money, and that there was nothing that they could do. Then when I called back later, they said that I should have taken different action the first time. Even though their employee misinfomred me as to the options available, they would take no responsibility for correcting the matter.

Insurance does not come into play here as the item was never shipped. The merchant admits this, but refuses to contact PayPal on my behalf to have them issue a refund. In this circumstance, PayPal really has no idea whether I received the item or not, so I'm not surprised that they wouldn't just take my word for it.

If you paid with a CC via Paypal contact the CC company. If your paypal debits your checking acct then you may be out of luck, since Paypal has already refused to refund.
